La respuesta <strong>depende de c\u00f3mo se ha obtenido la grabaci\u00f3n<\/strong>.<\/p>\n<h2 style=\"font-size: 20px; color: #366bba; font-weight: 400; margin-bottom: 15px; margin-top: 15px;\">Es fundamental distinguir dos grandes grupos en la admisi\u00f3n de im\u00e1genes y sonidos como prueba judicial:<\/h2>\n<p><span style=\"color: #366bba;\"><strong>A.<\/strong><\/span> Conversaci\u00f3n grabada por uno de los interlocutores.<\/p>\n<p><span style=\"color: #366bba;\"><strong>B.<\/strong><\/span> Conversaci\u00f3n grabada por un tercero.<br \/>\nEn el <strong>primer supuesto<\/strong> la respuesta es <strong>SI<\/strong>, se puede aportar a un procedimiento judicial una conversaci\u00f3n grabada por uno de los participantes. En relaci\u00f3n a ello se ha pronunciado en reiteradas ocasiones la sala de lo penal del Tribunal Supremo.<br \/>\nEl Tribunal Constitucional ha se\u00f1alado que \u201cno hay secreto para aquel a quien la comunicaci\u00f3n se dirige\u201d. Cosa distinta es que la difusi\u00f3n de estas grabaciones si pudiera atentar contra el derecho a la intimidad.<br \/>\nEn el <strong>segundo supuesto<\/strong>, solo las <strong>Fuerzas y Cuerpos de Seguridad del Estado<\/strong>, y previa autorizaci\u00f3n judicial, <strong>pueden grabar conversaciones o im\u00e1genes de otros<\/strong>. En caso de hacerlo un particular, puede ser constitutivo de un delito contra la intimidad del art\u00edculo 197.1 del C\u00f3digo Penal.<\/p>\n<p><span style=\"color: #366bba;\"><strong>C.<\/strong><\/span> Se podr\u00eda hablar de un tercer supuesto, en que la conversaci\u00f3n se produce <strong>mediante enga\u00f1o de quien pretende grabarla<\/strong>.<br \/>\nSi esa conversaci\u00f3n es inducida por un particular, la grabaci\u00f3n de <strong>im\u00e1genes y sonidos como prueba<\/strong> judicial se podr\u00eda admitir.<br \/>\nSi la conversaci\u00f3n es inducida por las Fuerzas y Cuerpos de Seguridad del Estado, mediando enga\u00f1o y superioridad, la doctrina del Tribunal Europeo de Derechos Humanos se\u00f1ala que hay que analizar la naturaleza y el grado de inducci\u00f3n para obtener la prueba, as\u00ed como el inter\u00e9s p\u00fablico.
